General Terms and Conditions – Inter-Connect Marketing GmbH

1. CRUISE CONTRACT
All the bookings are made based on the following General Terms and Conditions ofTravel. If bookings are made on the phone or in writing, the client expressly declares that he/she agrees with them upon concluding the contract. For voyages in which ICO is named as tour operator (cruises, flight ticket provided, hotels, transfers) the following travel conditions shall apply. Inter-Connect Marketing GmbH as General Agent of the cruise company Princess Cruises hereinafter called ICO/PC for short.

2. SERVICES/COLLATERAL AGREEMENTS
The scope of the contractual services is found in the service description in the catalogue and the reference specifications in the ICO/PC confirmation of the booking. Collateral agreements or special requests require express written confirmation drawn up by ICO/PC. Travel agents are not entitled to confirm collateral agreements themselves. If confirmation is not explicitly drawn up by ICO in the confirmation of the booking, the special requests may only be considered unbinding agreements, the provision of which cannot be guaranteed.

3. PAYMENT OF THE CRUISE PRICE AND DRAWING UP THE CRUISE DOCUMENTS
At the same time as the confirmation of booking you will receive evidence of the required insurance cover pursuant to § 651 k German Civil Code for all the payments made to ICO to the account of the travel services. The price for the voyage is due as follows:
· 20% of the price for the voyage upon receipt of the written confirmation of the cruise and 30% of the travel price when booking a flight .
· 80% of the total price for the voyage 6 weeks before embarking on said voyage and before the travel documents are handed over.
Upon receipt of full payment you receive the complete travel documents for the booked services in connection with the voyage from ICO or from your travel agent and any other travel information which may be necessary. The travel documents are ready for collection approx 2 weeks embarking on the voyage or are sent to you or to your travel agent. If bookings are made at short notice, the full price has to be paid immediately to ensure timely transfer of the travel documents.

4. SERVICES/PRICES
4.1. The scope of the contractual travel services is exclusively as drawn up in the booking confirmation in connection with the brochure or the description of the voyage applicable at the time of said voyage, under mention of all the points and descriptions mentioned therein. If conflicts should arise, the confirmation of the voyage is decisive.

4.2. The particulars contained in the brochure or in the description of the voyage, respectively, are principally binding for the travel agent, provided they have become the basis for the travel contract. The travel agent, however reserves the right to modify the brochure data or the travel description for factually legitimate, considerable or not foreseeable reasons before contract conclusion, about which the traveller, it goes without saying, is informed before finalising booking.

5. SERVICE AND PRICE MODIFICATIONS
5.1. Modifications and/or variances of individual travel services from the agreed upon contents of the travel contract which become necessary after conclusion of said contract and which cannot be traced to the travel agent not acting in good faith, are permitted, provided such modifications or variances are not of considerable nature, do not lead to considerable changes of the service and the overall style of the voyage booked is not impaired. This also applies to modifications of travel times and/or routes, particularly also for security and/or weather reasons which, in the case of cruises are solely decided by the captain on the ship.
5.2. The travel agent will inform the traveller of such variances of individual travel services immediately, provided and in as far as is possible for said travel agent to do so. The modified service then takes the place of the original contractual service due. If a traveller joins a voyage after the travel agent has informed him/her of a necessary change in the entire style of this voyage, then a cancellation based on this change of the Travel Contract after embarking on the voyage is excluded.

6. SERVICE AND PRICE MODIFICATIONS
6.1. ICO reserves the right to change the prices advertised and confirmed with the booking, provided a period of over 4 months lapses between conclusion of the contract and embarking on the voyage, if transportation costs increase particularly due to an increase of fuel costs, charges for certain services such as harbour dues and security fees or if the exchange rates concerned are affected to such an extent that this increase has an effect on the total price for the voyage per person. Should the price for the travel experience a subsequent change you will be informed immediately.
6.2. Should the increase involve more than 5% of the costs for the cruise you are entitled, without having to pay any handling charges, to cancel the travel contract. The cancellation has to be drawn up immediately upon being informed about the price change. Down payments already made are refunded.
6.3. You can, as alternative, demand another cruise from ICO/PC as long as ICO is able to offer such a cruise without additional price from its catalogue.

7. TRANSPORTATION SERVICES/CONNECTING FLIGHTS
If ICO/PC gives information of transportation times when providing the confirmation of the booking, these times are considered subject to change by the transportation companies. Should you yourself or your travel agent book further connecting flights or transfers, please note that the transport times published with the booking are not binding times and that time changes or delays in transportation may result for many a reason. When booking connecting flights or transfers, please make sure that the times in between are long enough. It is generally recommended that a rate is chosen which ensures that favourably priced re-booking is possible.

8. PASSPORT, VISA, CUSTOMS, FOREIGN EXCHANGE AND HEALTH DIRECTIVES
The passengers must have a valid, machine-readable passport for all cruises.
8.1. Each traveller is himself/herself responsible for complying with all the regulations necessary to be able to embark on the voyage. Any disadvantages that result from non-compliance are borne by the traveller, provided the reasons are not to be found in the insufficient or faulty information received from ICO/ PC. If you should not be a national of Germany, Austria or Switzerland, please explicitly inform ICO/PC.
8.2. If visa have to be applied for before starting off on the voyage, we recommend that you clarify with the applicable embassy (consulate), how long this may take even before you make a booking.
8.3. ICO will inform you correspondingly and in time about the known health regulations and recommended prophylaxis for the respective destination. Moreover, we recommend that you contact a doctor or a tropical institute.

9. EXTRAORDINARY CONDITIONS
Pregnant passengers must provide a medical certificate upon embarkation confirming that they may travel. Princess Cruises does not accept any passengers who are pregnant beyond the 21st week upon embarkation. A pregnancy has to be reported before embarking on a voyage. Any bodily disability which has to be paid attention to and which requires treatment must be indicated when applying for a reservation. The cruise may be declined for such persons, the health or bodily condition of whom seems to be too poor in the opinion of the shipping company, or whose condition may represent a danger for them or for other passengers.
9.1. If the voyage is considerably impeded or complicated, endangered or impaired for reasons of force majeure (e.g. war, terror, internal unrest, catastrophes of nature, exceptional weather conditions, major damage to the ship, strike of marine, airway, rail or bus personnel) the travel contract may be cancelled- both by the traveller or by the tour operator.

10. CANCELLATION OF THE VOYAGE , CHANGE OF RESERVATION
Should the cancellation be carried out by the passenger, ICO/PC must be informed in writing latest 80 days before embarking if a refund is to be made. Whatever the reason may be, a handling charge of EUR 75.00 per person will be due.
10.1. The client can cancel the travel contract whenever he/she wants to before embarking on the voyage. A written cancellation addressed to ICO is essential. If the client cancels or does not appear for the voyage for reasons for which ICO is by no means liable, ICO my demand befitting compensation for the travel preparations and for possible expenses already incurred. Cancellation charges are also to be paid if a passenger does not appear at the respective embarkation port or airport at the times drawn up in the travel documentation.

Our lump-sum entitlement to cancellation charges per person amounts to:

Up to the 80th day before starting off on the voyage: Handling charges €75 /person
From 79th day – 60th day before embarking: 10% of the price for the cruise
From 59th day – 45th day before embarking: 25% of the price for the cruise
From 44th day – 15th day before embarking: 50% of the price for the cruise
From 14th day – 8th day before embarking: 75% of the price for the cruise
From 7th day before embarking: 90% of the price for the cruise

Should flights, hotels and transfers etc. also be affected by the cancellation, the cancellation and ticket charges of the respective airways, hotels and agencies apply after the tickets have been issued. Whatever the case may be, all the expenses incurred by the company are reflected in the refund. The written application for refund must be sent to the ICO with the unused travel documents and not later than 60 days after departure date.

11. WARRANTY/REMEDY
If, in your opinion, the travel services prove to be deficient, please contact the person drawn up as contact in your travel documents immediately to ensure that a remedy can be found. Should the notice of defect not be received by this contact, the result may be that you cannot assert any claims in connection with the deficiency (reduction, compensation). No matter whether the deficiency was made known locally, you have to assert possible claims for reduction/compensation directly with ICO within 4 weeks after the contractual end of the travel service.

12. LIMITATION OF LIABILITY
If a damage has neither been induced intentionally or grossly negligently by ICO/PC, or if ICO bears sole responsibility for more reason of a default of a provider of services, the liability for damage, which does not involve not bodily injury, is limited to triple the amount due for the cruise. Claims arising from tortuous liability are not affected.

13. TRAVEL INSURANCE
A travel insurance is not included in the price for the voyage, however, we recommend that you take out an insurance cover for cancellation, for liability, a medical and accident insurance. If ICO or your travel agent offers you a travel insurance, this is only a brokerage service. The insurance contract is only drawn up between the client and the travel insurance company mentioned. Possible claims may only be asserted directly with the insurer. Please find the insurance conditions and obligations in the insurance contract.

14. GENERAL
14.1. All data in this brochure comply with the legal requirements upon printing in November 2007.
14.2. The inoperativeness of individual provisions of the travel contract does not result in the entire travel contract becoming inoperative. The same applies to the terms and conditions of travel as submitted.
14.3. The court of jurisdiction is Munich for registered merchants, legal entities or separate assets under public law, for persons who have no general court of jurisdiction and for persons who, upon conclusion of the contract, have changed their domicile or whose domicile is not known upon institution of legal proceedings, and for defendant’s lawsuits. Otherwise the court of jurisdiction for legal action complies with the domicile of the defendant.
14.4. ICO/PC bears no liability for possible printing errors.
14.5. Information is given to the best of our knowledge, however is not binding.
